By using our website or placing an order, you agree to these Terms of Service, subject to your rights under applicable South African law.

2. Eligibility to Purchase

By using our website or placing an order, you confirm that:

  • You will use our website for lawful purposes.

We reserve the right to refuse transactions where there are reasonable grounds to suspect fraudulent or unlawful activity.

We make reasonable efforts to ensure that product descriptions, specifications, images, prices and availability are accurate.

Please note:

  • All prices are displayed in South African Rand (ZAR).

  • Product availability is subject to stock.

  • Product images are intended to represent the actual products, although minor differences in appearance, colour or packaging may occur.

  • Prices may change from time to time.

  • Product ranges may be updated or discontinued.

The price applicable to your order will ordinarily be the price confirmed at checkout, subject to applicable law and the correction of genuine errors.

Any mandatory taxes or additional charges will be disclosed as required by law.

4. Orders and Order Acceptance

When you place an order, you will receive an order confirmation through the contact details supplied during checkout.

We reserve the right, where legally permitted, to decline or cancel an order for legitimate reasons, including:

  • Products being unavailable or out of stock.

  • Genuine pricing or listing errors.

  • Unsuccessful or unverified payments.

  • Suspected fraudulent transactions.

  • Incorrect or incomplete delivery information.

  • Circumstances that prevent lawful fulfilment.

If we cancel an order after receiving payment, we will refund the amount paid for the cancelled items, together with any associated delivery charges where applicable.

Nothing in this section limits your rights under applicable consumer protection legislation.

5. Payments and Transaction Security

Gifts R Us uses authorised third-party payment service providers to process online transactions.

Available payment options may include:

  • Credit and debit cards.

  • Instant electronic funds transfer (EFT).

  • Other secure payment methods displayed at checkout.

The payment methods available to you will be those shown during checkout.

Payments are processed through the relevant payment provider's secure systems. Gifts R Us does not intentionally store complete payment-card details on its own website systems.

Customers are responsible for providing accurate billing information and ensuring that they are authorised to use their chosen payment method.

6. Shipping and Delivery

Gifts R Us delivers to eligible addresses throughout South Africa using courier partners, including Aramex and The Courier Guy, where available.

Our intended shipping arrangements include:

  • Aramex delivery: R89.99 for qualifying orders below R800.

  • The Courier Guy: Applicable delivery charges calculated at checkout.

  • Free delivery: Qualifying orders of R800 or more.

  • Estimated delivery timeframe: Generally 8–11 business days, depending on the product, destination and courier service.

The delivery charges and options confirmed at checkout will apply to your order.

Delivery estimates are not guarantees unless expressly stated otherwise.

Delays may arise from severe weather, public holidays, courier disruptions, remote delivery locations or circumstances beyond our reasonable control.

We will make reasonable efforts to communicate material delays and fulfil our obligations under applicable South African law.

Risk of loss or damage to goods remains with Gifts R Us until the goods are delivered to the customer or a person designated by the customer, as required by the Consumer Protection Act.

7. Returns, Exchanges and Refunds

Returns, exchanges, cancellations and refunds are governed by our Return & Refund Policy, together with applicable South African consumer protection legislation.

Our voluntary change-of-mind return period is 7 calendar days from delivery, subject to the eligibility requirements set out in that policy.

This does not restrict statutory rights, including applicable rights concerning defective goods, incorrect products or qualifying online transactions.

Customers are encouraged to contact us promptly if they experience any issue with an order.

8. Product Use and Safety

Customers are responsible for using products safely and in accordance with any supplied instructions, warnings or manufacturer recommendations.

Where applicable, customers should:

  • Read product instructions before use.

  • Follow recommended care and maintenance procedures.

  • Use products only for their intended purpose.

  • Keep potentially hazardous products away from children.

  • Exercise appropriate caution when using sharp objects, electrical appliances and other products requiring special handling.

Gifts R Us will not be responsible for loss or damage caused solely by improper use, unauthorised modification or disregard of reasonable safety instructions, to the extent permitted by law.

Nothing in this section excludes liability or consumer remedies that cannot lawfully be excluded.

9. Product Warranties and Guarantees

Certain products may be supplied with manufacturer warranties or other applicable guarantees.

Any additional manufacturer warranty will be subject to its stated terms, provided those terms comply with applicable law.

Under the Consumer Protection Act 68 of 2008, consumers may have statutory rights concerning the quality, safety and durability of goods, including the implied warranty of quality under section 56.

These statutory rights apply independently of any voluntary manufacturer warranty.

10. Promotions, Discounts and Special Offers

Gifts R Us may offer promotional discounts, special offers, discount codes and limited-time campaigns.

Unless otherwise stated:

  • Promotions apply only during their advertised validity periods.

  • Discount codes are subject to any stated eligibility requirements.

  • Certain promotions may not be combined.

  • Promotional offers are subject to applicable stock availability.

  • Discounts cannot ordinarily be exchanged for cash.

  • Discounts cannot be applied retrospectively unless expressly permitted.

We reserve the right to correct promotional errors or withdraw offers where legally permissible.

11. Gift Purchases and Delivery Information

Customers purchasing gifts for another person must ensure that the recipient's delivery information is accurate.

Gifts R Us cannot guarantee successful delivery where incorrect, incomplete or inaccessible delivery details are supplied.

Where delivery is unsuccessful, we will communicate the available options and any lawful additional delivery charges.

Customers must ensure that they are authorised to provide the recipient's personal information for the purpose of arranging delivery.

12. Intellectual Property

All original content associated with Gifts R Us, including its branding, logos, website content, graphics, marketing material, product descriptions and original photographs, is owned by Gifts R Us or used under appropriate permission or licence.

This content may be protected by South African and international intellectual property laws.

You may not reproduce, distribute, modify, commercially exploit or otherwise use protected material without the necessary authorisation, except where permitted by law.

Third-party trademarks and brand names remain the property of their respective owners.

13. Acceptable Website Use

Nothing in these Terms excludes or limits liability for gross negligence, unlawful conduct, defective or unsafe goods, or any other liability that cannot legally be excluded.

No limitation of liability in these Terms shall override the protections afforded by the Consumer Protection Act 68 of 2008 or other applicable legislation.

We collect and process personal information for legitimate purposes such as:

Nothing in these Terms prevents a customer from approaching a competent court, the National Consumer Commission, a relevant consumer ombud or another authorised dispute-resolution body where legally entitled to do so.

Updated Terms will be published on our website with a revised effective date where appropriate.

Changes will not retrospectively remove rights arising from orders already concluded.
